Terms of Sale – United States Customers

These Terms of Sale ("Terms") govern purchases made through the TLCW website
by customers located in the United States. By placing an order, you agree to these
Terms.

1. Our Contract with You
The sale of products through this website is conducted by TLCWW ("TLCWW", "we", "our", or "us")
By placing an order, you confirm that:
- You are legally capable of entering into a binding contract;
- All information provided is accurate and complete; and
- You are authorized to use the payment method provided.
TLCW reserves the right to refuse, cancel, or limit any order at its sole discretion.

2. Pricing and Payment
All prices displayed on the website are shown in U.S. Dollars (USD) unless
otherwise stated.
Payment must be received and approved before an order is processed and shipped.
TLCW reserves the right to correct pricing errors, product descriptions, or website
inaccuracies at any time without prior notice.

3. Shipping, Customs Clearance and Importation
TLCW offers shipping to eligible U.S. customers using a Delivered Duty Paid (DDP)
service.
Under TLCW's DDP shipping program:
- TLCW arranges international transportation;
- TLCW arranges customs clearance;
- TLCW pays applicable import duties and taxes assessed in the ordinary
course of importation; and
- Customers receive their orders without additional routine import charges upon
delivery.
Customers must provide accurate shipping, billing, and contact details.

Customers agree to cooperate with reasonable requests from TLCW, DHL Express,
customs authorities, or other government agencies in connection with:
- Customs clearance;
- Import compliance;
- Regulatory review;
- Delivery verification; or
- Shipment-related inquiries.
Failure to provide requested information may result in delivery delays, shipment
returns, shipment abandonment, order cancellation, or additional charges.

4. International Shipping and Import Handling Fee
A flat international shipping and import handling fee of USD 35 per order applies to
U.S. shipments.
This fee contributes toward:
- International transportation;
- Customs brokerage;
- Import processing;
- Duties and taxes;
- Clearance administration; and
- Cross-border logistics costs.

TLCW reserves the right to recover additional costs incurred as a result of:
- Incorrect customer information;
- Address corrections;
- Delivery rerouting requests;
- Refused deliveries;
- Failure to cooperate with customs requirements; or
- Any customer-caused event resulting in additional carrier, customs or
administrative charges.

5. Delivery

Estimated delivery times are provided for reference only and are not guaranteed.
Most orders are expected to be delivered within 3–5 business days after dispatch,
although delivery times may vary due to:
- Customs inspections;
- Regulatory requirements;
- Carrier capacity constraints;
- Weather disruptions;
- Peak shipping periods; or
- Circumstances beyond TLCW's reasonable control.
TLCW may use DHL Express or another carrier where operationally necessary.

6. Tracking and Proof of Delivery
Tracking information will be provided when available.
A delivery confirmation, signature record, photographic evidence, electronic tracking
event, geo-location delivery record, or other proof of delivery maintained by DHL
Express or the carrier shall constitute evidence of successful delivery.
Risk of loss passes to the customer upon successful delivery to the delivery address
provided at checkout.

7. Lost Shipments
A shipment will not be considered lost until the carrier has completed its investigation
and formally confirms that the shipment cannot be located.
If a shipment is confirmed lost, TLCW may, at its discretion:
- Replace the product; or
- Refund the amount paid for the affected order.

8. Returns and Refunds
Due to hygiene, product integrity, and quality-control considerations, TLCW does not
accept returns or exchanges for:
- Change of mind;
- Personal preference;

- Incorrect product selection by the customer; or
- Normal wear and tear.
Customers are encouraged to review product specifications, sizing information,
materials, and images carefully before placing an order.
Nothing in these Terms limits any rights that cannot be excluded under applicable
law.

9. Damaged, Defective or Incorrect Items
If a product arrives damaged, defective, or materially different from the item ordered,
the customer must contact TLCW within 7 calendar days of delivery.
Claims must include:
- Order number;
- Clear photographs of the product;
- Photographs of the shipping label;
- Photographs of the external packaging; and
-Any additional information reasonably requested by TLCW.
Upon verification, TLCW may, at its discretion:
- Replace the product;
- Issue store credit; or
- Provide another appropriate remedy.

10. Refused or Undeliverable Shipments
If a shipment is refused, abandoned, or returned as a result of:
- Customer refusal;
- Incorrect address information;
- Failure to respond to customs requests; or
- Failure to accept delivery,
TLCW reserves the right to deduct from any refund:
- Shipping charges;
- Return shipping costs;

- Duties and taxes;
- Brokerage fees;
- Storage fees; and
- Administrative expenses associated with the return.

11. Product Information
TLCW strives to ensure that all product descriptions, specifications, photographs and
pricing information are accurate.
However:
- Colors may vary depending on screen settings;
- Product appearance may vary slightly from displayed images; and
- Minor variations in materials, finish or manufacturing characteristics do not
constitute defects.

12. Limitation of Liability
To the fullest extent permitted by applicable law:
- TLCW shall not be liable for any indirect, incidental, special, punitive or
consequential damages arising from the purchase or use of its products.
- TLCW's total liability arising from any claim related to an order shall not
exceed the amount paid by the customer for the product in question.

13. Force Majeure
TLCW shall not be liable for delays or failures caused by circumstances beyond its
reasonable control, including:
- Customs examinations;
- Government actions;
- Regulatory requirements;
- Natural disasters;
- Extreme weather;
- Transportation disruptions;
- Labor disputes;

- Cybersecurity incidents;
- Public health emergencies; or
- Carrier operational interruptions.

14. Governing Law
These Terms shall be governed and interpreted in accordance with the laws of
Japan, to the extent permitted by applicable law.
Nothing in these Terms shall limit any mandatory consumer rights available under
applicable law.
